Etihad Stadium striker may well have finally seen sense.
BBC Sport has learned Manchester City striker Carlos Tevez will not contest his misconduct charge
City found the Argentine guilty of five breaches of contract in a Champions League game against Bayern Munich in September.
Manager Roberto Mancini wanted to bring Tevez on as a substitute with 35 minutes left but he refused to warm up.
Is is understood that Tevez believes a move away from the club in the January transfer window is now the best option.

This may well not resolve the outstanding issues that the club and Carlos Tevez has with each other, namely that the Argentine has twice stated his desire to leave and Roberto Mancini has stated that he has no intention of playing the former West Ham and Man United man.
The fact that City are doing splendidly without Tevez basically ensures that as soon as a good offer comes in for his services he will be on his way. This move of contrition may just be the player’s way of telling prospective employers that he is not as much of a nutcase as he looks.
Who will fool for that though?
